Terms of Service for GTO Warmup

Agreement to Terms

By downloading, accessing, or using the GTO Warmup mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use our App.

Description of Service

GTO Warmup is a mobile application designed to help poker players improve their game through practice sessions, goal setting, and performance tracking. The App includes both free and premium features.

Free Features

• Limited daily warm-up sessions
• Basic goal setting
• Essential statistics

Premium Features

• Unlimited warm-up sessions
• Focus sessions
• Advanced statistics and analytics
• Priority customer support

User Accounts and Registration

Account Creation

• You may use certain features without creating an account
• Premium features require account creation
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account

Account Responsibilities

• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized use
• You may not share your account credentials with others
• You must be at least 13 years old to create an account

Subscription and Payment Terms

Premium Subscriptions

• Premium subscriptions are available on a monthly or annual basis
• Prices are subject to change with 30 days notice to existing subscribers
• Subscriptions automatically renew unless cancelled
• You can cancel your subscription at any time through your device's app store settings

Free Trial

• New users may be eligible for a free trial of premium features
• Free trials automatically convert to paid subscriptions unless cancelled
• Only one free trial per user account
• Free trial terms are subject to change

Refunds and Cancellations

• Subscription payments are processed through the App Store (iOS) or Google Play Store (Android)
• Refund requests must be made through your respective app store
• Cancelling a subscription stops future charges but does not refund current billing period
• Premium features remain available until the end of the current billing period

Payment Processing

• All payments are processed by Apple (iOS) or Google (Android)
• We do not store your payment information
• Billing issues should be directed to your app store provider

User Content and Conduct

Your Content

• You retain ownership of content you create in the App (goals, notes, etc.)
• You grant us a license to store and process your content to provide our services
• You are responsible for backing up your important data
• We may delete inactive accounts and associated content after 2 years

Prohibited Uses

You agree not to use the App to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit harmful or malicious code
• Attempt to gain unauthorized access to our systems
• Use the App for commercial purposes without permission
• Interfere with other users' experience

Intellectual Property Rights

Our Content

• The App and its content are protected by copyright, trademark, and other laws
• We grant you a limited, non-exclusive license to use the App for personal use
• You may not copy, modify, distribute, or create derivative works of our content
• All trademarks and logos are the property of their respective owners

Poker Strategy Content

• The App provides educational content about poker strategy
• Content is for educational purposes only and not gambling advice
• We make no guarantees about the effectiveness of strategies presented
• Users are responsible for compliance with local gambling laws

Disclaimers and Limitations

Service Availability

• We strive to maintain App availability but cannot guarantee uninterrupted service
• We may suspend or terminate service for maintenance, updates, or other reasons
• We are not liable for any damages resulting from service interruptions

Educational Content

• The App provides educational content about poker strategy
• We make no representations about the accuracy or completeness of strategy content
• Individual results may vary based on skill level, experience, and other factors
• Content should not be considered professional gambling advice

User Responsibility

• You are solely responsible for your use of poker knowledge and strategies
• We are not responsible for any gambling losses or decisions made based on App content
• Users must comply with all applicable laws regarding gambling in their jurisdiction

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the App in the last 12 months
• Some jurisdictions do not allow certain limitations, so these may not apply to you

Privacy and Data Protection

• Our collection and use of personal information is governed by our Privacy Policy
• By using the App, you consent to our Privacy Policy
• We implement reasonable security measures to protect your data
• You can delete your account and associated data at any time

Modifications to Terms

• We may modify these Terms at any time
• Material changes will be communicated through the App or via email
• Continued use of the App after changes constitutes acceptance
• If you disagree with changes, you may discontinue use of the App

Age Requirements

• You must be at least 13 years old to use the App
• Users between 13-17 must have parental consent
• In jurisdictions where the age of digital consent is higher, that age applies
• We may request age verification at any time

Geographic Restrictions

• The App may not be available in all countries or regions
• You are responsible for compliance with local laws and regulations

• Export laws may apply to the App and its content

Termination

By You

• You may stop using the App at any time
• You can delete your account through the App settings
• Cancelling subscriptions does not automatically delete your account

By Us

We may terminate or suspend your access if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay subscription fees
• Use the App in a way that harms our service or other users

Effect of Termination

• Your right to use the App immediately ceases
• We may delete your account and associated data
• Provisions that should survive termination will remain in effect

Governing Law and Disputes

• These Terms are governed by applicable law in your jurisdiction
• Any disputes will be resolved through binding arbitration
• Class action lawsuits are waived where permitted by law
• You may opt out of arbitration by contacting us within 30 days of first use
